The Punjab and Haryana High Court has asserted the condition in a notification that AC stage carriages in Punjab would be run only by the State Transport Undertakings (STU) was, prima facie, violative of Articles 14 and 19 of the Constitution.
While Article 14 is on equality before law, Article 19 deals with freedom of trade and occupation.
The observation by the Bench of Acting Chief Justice Rajiv Sharma and Justice Harinder Singh Sidhu came on a petition filed by Rayia Tourist Company, Barnala, versus the State of Punjab and another respondent. The case was taken up by the Bench on September 25, but the copy of its order became available subsequently.
The Bench asserted: “Consequently, there shall be an interim stay on the notifications issued on February 22, 2018, and June 4 to the extent it excludes private transport operators from plying AC buses. It is, however, clarified that the STUs shall continue to operate the AC stage carriages as per the notification”.
The Bench also issued a notice of motion for October 30, which was accepted on behalf of the respondents by Assistant Advocate General Lavanya Paul. The petitioner, among other things, was seeking the quashing of the Punjab Road Transport Scheme notification dated February 22, 2018, whereby the state government made it clear that only the Transport Department could run AC buses. According to the notification, the petitioner could not apply for AC route permits in the state.
