Acting on a petition filed in public interest against the proposed pardon and pre-mature release of life convicts as part of Guru Nanak's 550th birth anniversary celebrations, the Punjab and Haryana High Court today directed the Chief Secretary to take a decision on representation in this regard.

The matter was brought under the High Court scanner by advocate HC Arora. In his petition placed before the Division Bench of Justice Rajiv Sharma and Justice Harinder Singh Sidhu, Arora alleged that the Punjab government/Governor did not consider the impact on the victims’ families and society before granting pardon to murder convicts or releasing them under premature release policy.

Pardon was granted secretly without hearing the families. No compensation was paid to them, while releasing convicts prematurely or while pardoning them, he added. Arora told the Bench that he had demanded, through a notice sent to the Chief Secretary on June 25, that the victim families should be given a hearing in order to enable them to oppose the proposed pardon. Adequate compensation to the families for their sufferings on account of murder was also sought.

Arora added that he had rather demanded Rs 1 crore as compensation for a victim, Harjit Singh, killed by four policemen during a false encounter. He alleged that the murderers/police officials had been pardoned by the Governor in May. He demanded that at least Rs 10 lakh as compensation for family of another murder victim, in case of premature release of such murder convicts. The Bench directed the Chief Secretary to take a decision on petitioner’s representation in accordance with law at an early date after giving a hearing to him.
